Privacy Policy

The purpose of this Privacy Policy (the “Privacy Policy”) is to inform you of our policies and procedures regarding the collection, use, and disclosure of certain information that Varlah Pty. Ltd. (referred to throughout the Privacy Policy as either “Varlah,” “us”, “our”, or “we”) accumulates as a result of your use of www.getdiced.com.au, www.getdiced.co.nz, www.varlah.com and www.varlah.com.au (the “Websites”). This Privacy Policy may be updated from time to time. You are advised to consult this Privacy Policy regularly for any changes.

The Types of Information Collected

Personal information voluntarily provided by you when creating your Varlah account to access the Websites (the “Account”) (including, without limitation, your name, email address, mailing address, and telephone number) or when placing an order, and any other information provided by you that specifically identifies you, is treated by Varlah as “Personal Information”. Varlah understands that the protection of such Personal Information is important to you and for that reason, Varlah does not share or sell any Personal Information with or to any third parties, except as described herein or on the Websites. We may share Personal Information as follows: with service suppliers or providers who are working with us in connection with the operation of the website; when you give us consent to do so; when we believe in good faith that we are legally authorised or required to do so, and that doing so is reasonably necessary or appropriate to comply with the law, including responding to lawful subpoenas, warrants, or court orders; and to enforce or apply this Privacy Policy, Varlah’s Terms and Conditions or our other policies or agreements.

We may also use Personal Information to allow us to deliver information you request, to allow delivery of a product you order, to provide customer service by responding to your emails, submissions, questions, comments, requests, and complaints, and to send you confirmations, updates, security alerts, support, and administrative messages. As part of your use of the Websites, we may need to contact you with materials such as service announcements, administrative messages, newsletters, promotional and advertising materials and other such communications from Varlah and its partner organisations. These communications are considered part of your use of the Websites and your Account, which you may not be able to opt-out from receiving, except to the extent required by law.

As part of your use of the Websites, you may supply the Websites with articles, stories, photos, videos, links, events, comments, notes, messages, and other information. This content, combined with all activity taking place during your use of the Websites, (“User Generated Content”), may be tracked, logged, and stored by Varlah. You hereby assign and transfer to Varlah all of your rights, title, and interest in all User Generated Content, and Varlah reserves the rights to all User Generated Content provided through the use of the Website.

We also collect information that you provide when creating your Account and personalising your user preferences on the Websites, including, without limitation, post code, age and gender (“Non-Identifying Information”). Non-Identifying information is not considered Personal Information.

Through your use of the Websites, our servers automatically record information that your browser sends whenever you visit the Website (“Log Data”). Our server may log details about any computer used to access the Website (such as the IP address, operating system and browser type), the date and time of access, and details of the information downloaded. This Log Data may include non-personal information such as your Internet Protocol address, the operating system being used, the browser type, the address of a referring website, and your activity on our Websites including time spent, pages visited, information searched, access times and dates, and other related statistics. We may use Log Data to monitor and analyse Websites usage and trends, and to personalise and improve the Websites and customer experiences on the Websites as well as to provide ads, content, or features that match our users’ profiles and interests. We also use this information to increase the Websites’ functionality and user friendliness, and to verify that visitors to the Websites meet the criteria required for use of the Websites.

We may combine your User Generated Content, Non-Identifying Information and/or Log Data and aggregate it with information collected from other users to improve the quality of our product. We may also share or sell Non-Identifying Information and/or Log Data with or to our affiliates and business partners. Any information shared in these contexts will not personally identify you.

Like many other websites, information may also be automatically collected through the use of “cookies” or web beacons. A cookie is a small data file that we transfer to your computer’s hard drive for record-keeping purposes. We use these to save your search preferences and Personal Information, as well as registration ID and login password for future use of the Websites. We also use them to enable certain features of the Websites, to better understand how you interact with the Websites, and to monitor aggregate usage by our users and web traffic routing on the Websites.

Varlah does not knowingly maintain Personal Information, User Generated Content, Non-Identifiable Information, or Log Data for individuals under the age of 18.

Third Parties and Links to Other Sites

Online payments are handled by Stripe external third party services providers. We do not see or store your credit card or banking information. Please check the stripe.com website for details of their privacy policies and security measures.

We may institute programs with advertising partners and other websites in which they share information with us. We may ask advertisers to tell us how our users responded to the ads we provided. This data sharing helps us measure our advertising effectiveness and improve the quality of the advertisements you see.

We are not responsible for the actions of service providers or other third parties, including those whose links can be accessed through the Website, nor are we responsible for any additional information you provide directly to those third parties. The fact that we present a link to a website or a banner ad or other type of advertisement is not necessarily an endorsement, authorisation, or representation of our affiliation with that third party, nor is it an endorsement of their privacy policy or practices. Any information you provide once you have left our Website, or provide directly to the third party,  is subject to that third party’s privacy policy, and as such we encourage that you read the privacy policies or statements of the other websites you visit.

Third-party advertisers on the Website may also place or read cookies on your browser. You can instruct your browser, by changing its options, to stop accepting cookies or to prompt you before you accept a cookie from the websites you visit. If you do not accept cookies, however, you may not be able to use all portions of or all functionality of the Website.

Business Transfers

Varlah may sell, transfer or otherwise share some or all of its assets, including your Personal Information, in connection with a merger, acquisition, reorganisation or sale of assets or in the event of bankruptcy.

Security

Varlah takes reasonable measures to protect your personal information in an effort to prevent loss, misuse, and unauthorised access, disclosure, alteration, and destruction. Please be aware that despite our efforts, no security measures are 100% secure or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse.

International Transfer

Your information may be transferred to – and maintained on – computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

Removing Information or Deleting Your Account

If you want to stop using your Account you can request that we delete your account. When we delete your Account, it is permanently deleted from the Website. You should only request that we delete your Account if you are certain that you will not want to use the Websites at any later date.

Even after we remove User Generated Content from your profile or delete your Account, copies may remain viewable elsewhere to the extent that they have been available and copied or stored by other users of the Websites.

Removed and deleted information may persist in backup copies for up to 90 days, but will not be available to other users.

Changes to this Privacy Policy

This Privacy Policy may change from time to time. Any changes to the Privacy Policy will be highlighted in this area from time to time.
